GENERAL TERMS AND CONDITIONS FOR ONLINE PURCHASE

1. INTRODUCTION

1.1. The Voyages World website, thevoyagesworld.com, is operated by Jessicacindy Pte. Ltd. (UEN No. 201329447D) with its registered office at 176 Orchard Road #05-05 The CentrePoint Singapore 238843 (hereinafter referred to as “Voyages” or “we” and “us and “our” as construed accordingly). All information, products and services contained in our website shall be subject to the terms and condition set out herein (the “Terms and Conditions”).

1.2. You agree to be bound to our Terms and Conditions and Privacy Policy (collectively “Web Terms”) as long as you are using our website, which may include but is not limited to the following instances:-

a. Entering, accessing and/or browsing our website;

b. Purchasing of product(s) from our website;

c. Indicating a request for Private Access from our website.

1.3. For avoidance of doubt, we reserve the rights to amend or alter the Web Terms from time to time with notice provided to you as per Clause 10.

1.4. By using our website, you warrant that:-

a. You have fully read and understand our Web Terms in its entirety;

b. You have the legal capacity to agree to our Web Terms;

c. You are accessing and using our website for lawful purposes only and in accordance with our Web Terms; and

d. All of the information provided by you to us (including personal credentials and contact details) is accurate and complete.

1.5. In the event you do not accept the Web Terms (which may change from time to time), you are to refrain from using our website immediately.

1.6. Our website is operated in Singapore. We make no representation that the contents, products and services available on our website are appropriate or available for use in your location. Should you choose to access this website from any location apart from Singapore, you can do so on your own initiative and you are responsible for compliance with the local laws, if and to the extent local laws are applicable.

1.7. Our Web Terms shall be governed and construed in accordance with the laws of Singapore, except where mandatory consumer protection laws or applicable regulations of another jurisdiction applies.

1.8. Transactions fulfilled within the United States may also be subjected to the applicable laws and regulation of the United States.

2. DEFINITIONS

2.1. “Object” or “Objects” refers to a product or products created with rare materials and traditional craftmanship, collectibles, and selected Archive pieces curated by Voyages;

2.2. “Private Access” refers to the invitation-based and time-limited admission for selected guests to experience and purchase Objects via the Voyages Private Salon;

2.3. “Voyages Chapter” refers to a limited release of Objects made available by Voyages from time to time, during which curated Objects would be offered for purchase in limited quantities and for a limited period as determined by us;

2.4. “Voyages Private Salon” refers to a restricted-access section on our website. Access is granted only to selected guests who have submitted a Private Access request and have received an approved access link from us. Only guest with a valid access link may enter the Private Salon to view and purchase Objects made available during the Access Period;

2.5. “Access Period” refers to the time-limited purchasing window during which selected guests are granted Private Access to purchase Objects from a given Voyages Chapter; and

2.6. “Voyages Archive” refers to the official record maintained by Voyages which documents the authentication and ownership of all Voyages Objects.

3. ORDERS AND AVAILBILITY

3.1. Each Object featured in a Voyages Chapter is made available in limited quantities.

3.2. Objects offered via the Voyages Private Salon are subject to availability, depending on the natural materials selected for the relevant Voyage Chapter, and confirmation by us.

3.3. Due to the limited nature of the Objects (which would be released in limited quantities via each Voyages Chapter), availability of the Objects cannot be guaranteed.

3.4. We reserve our rights to determine the release of a certain Object (in a specific material and design) and the quantities available for a given Voyages Chapter. There is no guarantee that an Object released in a given Voyages Chapter may be available again in the future. Objects which are considered seasonal creations are limited editions that would not be repeated.

4. VOYAGES PRIVATE SALON & PRIVATE ACCESS

4.1. The purchase of an Object can only be done online exclusively via our Voyages Private Salon. For more information of the Voyages Private Salon, please refer to our Client Care-FAQ page.

4.2. Access to the Voyages Private Salon is granted on an invitation-basis only. A designated link will be provided to selected guests who have been granted the Voyages Private Access. Guests who are interested to be considered for our Voyages Private Access may submit their request to us online via our website at thevoyagesworld.com. Requests for Private Access may be submitted at any time while the relevant Voyages Chapter remains available. For more information on our Voyages Private Access, please refer to our Client Care-FAQ page.

4.3. By submitting a request for Private Access, you agree that it is only an indication of interest and the submission of request is not a representation or guarantee by us that access would be automatically granted to you. How Private Access is granted is confidential and remains the sole discretion of Voyages. We fully reserve the right to review your submission for Private Access and to determine if such access should be granted to you. You agree that any decisions made by us in relation to the granting of Private Access shall be final and conclusive, and there is no obligation for us to provide you with any justifications in the event requests are denied.

4.4. Our decision in relation to requests for Private Access are released on a weekly basis every Tuesday, unless otherwise expressly stated by us for special Chapter releases or via updates. Subject to Clause 4.3 above, guests who have submitted request for Private Access will receive an email confirming whether the Private Access has been granted or refused.

4.5. Private Access is time-limited and provides selected guests with a purchasing window during which they may purchase Objects from a given Voyages Chapter.

4.6. Private Access invitations may be extended to the Voyages’ archive of registered guests and collectors.

4.7. We reserve our rights to revoke any extension of Private Access should the access link be shared with any other third parties.

4.8. While accessing Voyages Private Salon, the Object(s) that are placed in the Shopping Bag are not deemed to be reserved. You agree that it is your responsibility to secure an Object by proceeding to check-out and making payment of your Object(s) in the Shopping Bag within the Access Period. We are not responsible if an Object in your Shopping Bag becomes no longer available before check-out and payment.

4.9. All orders placed by you are subject to our acceptance. For avoidance of doubt, even if an order is placed correctly and you have read and accepted to our Web Terms, the contract does not become effective as long as we do not accept it. Once an order is accepted (“Order Confirmation”), we will send you a confirmation email addressed to the email address you indicated in your order and/or your registered credentials with us. Only orders which are accepted by us shall constitute a contract for sale and purchase of goods between us and yourself.

4.10. It is your responsibility to ensure that the email address provided by you is accurate and updated to receive the Order Confirmation. It is also your responsibility to check your spam or junk folder just in case our email was directed to those folders. In the event you did not receive the confirmation email, you are to contact us immediately at care@thevoyagesworld.com. We reserve our rights to request for further information or supporting documents from you for verification purposes, including but not limited to the following information:-

a. Your full name, address and email indicated while placing order;

b. The details of your order (Object description, size and quantity);

c. The date and time of check-out / payment, including supporting payment proof.

5. PRICING AND PAYMENT

5.1. All prices are displayed in the selected currency depending on your location. The price of an Object displayed is inclusive of applicable taxes within the countries of fulfilment (i.e., Singapore and the United States). The price of an Object excludes delivery charges and import duties / taxes / customs charges (if any imposed by the destination country). Should any delivery charges be applicable, it would be indicated and reflected on the final check-out page prior to you making payment.

5.2. We reserve the right to revise the prices of our Objects at any time and without prior notice. However, such changes will not apply to orders that have been accepted by us.

5.3. For international orders, import duties, local taxes, and customs charges may apply depending on the shipping destination. Where applicable, you remain solely responsible for the payment of such duties, taxes, and customs charges.

5.4. We accept payment by credit card via American Express©, Visa©, and Mastercard©. Apple Pay © and Google Pay © are also available on supported devices. All payments are securely processed through Stripe.

5.5. By making payment via credit card, you warrant that you are the licensed cardholder of the credit card (or authorised by the licensed cardholder of the credit card) in making the transaction.

5.6. Voyages reserves the right to verify payment details prior to processing an order. Orders may be cancelled if payment authorisation cannot be obtained.

5.7. If a payment dispute or chargeback is initiated without first contacting Voyages Client Care to seek resolution, we reserve the right to dispute the claim and may suspend future purchasing privileges associated with the account.

6. INCORRECT, DAMAGED or DEFECTIVE OBJECT

6.1. If you received an incorrect, damaged or defective Object, please email us at care@thevoyagesworld.com within forty-eight (48) hours of receiving the Object, citing your order number, contact details and indicate whether the issue relates to an incorrect, damaged, or defective Object. Please attach clear supporting photographs of the incorrect, damaged or defective Object. Our team will review the matter and assist you promptly.

6.2. Upon reviewing your email and supporting photographs, Voyages will have the sole discretion to determine whether it is an incorrect, damaged or defective Object. For the avoidance of doubt, variations in natural materials (e.g., cashmere fibre) would not be considered as defects.

6.3. In the event our team has confirmed the incorrect, defective or damaged Object, we will make arrangements for the Object to be returned to us and for a replacement Object to be shipped to you, subject to availability. Any shipping costs incurred will be borne by us in the event of an incorrect, damaged or defective Object. All returns will be arranged with an approved shipping partner.

6.4. When reporting and returning an incorrect, damaged or defective Object, the Object in question must satisfy the following conditions: –

a. Unworn, unwashed, unused and unaltered;

b. In its original condition it was shipped out;

c. In its complete original packaging, tags / labels attached and any related accessories included; and

d. Includes all authentication materials and documentation.

6.5. Once the incorrect, damaged or defective Object has been returned and approved by us, we may:-

6.5.1. Issue you a replacement Object (subject to availability); or

6.5.2. Issue a refund to your original payment method. Please note that, depending on your financial institution, it may take up to ten (10) business days or more for the refund to be reflected to your account statement.

7. RETURNS ANDS EXCHANGED POLICY

7.1. At Voyages, each Object is created with intention and utmost care. Should you wish to return or exchange an Object , the following terms shall apply:-

7.1.1. Returns may only be applicable for certain Objects. For Objects which are bespoke, customised, personalised or made to measure, returns and exchanges are strictly not permitted.

7.1.2. Request for returns (“Request for Returns”) must be made within fourteen (14) days of receiving your order.

7.1.3. An Object that can be returned in accordance to Clause 7 must satisfy the following conditions:-

a. Unworn, unwashed, unused and unaltered;

b. In its original condition it was shipped out;

c. Returned in its complete original packaging, tags / labels attached and any related accessories included; and

d. Returned with all authentication materials and documentation

7.2. Notwithstanding Clause 7.1 above, we reserve the right to refuse any returns that do not satisfy the conditions stipulated above or returns that are in any other condition that would reasonably suggest that an Object has been used or worn.

7.3. Our decision to refuse any returns is final and conclusive. In such an event, you shall be fully responsible for the cost of returning the Object from us to you.

7.4. For more information on how to initiate a return, please refer to our FAQS page. Any Request for Returns must be emailed to Voyages Client Care at care@thevoyagesworld.com within the stipulated timeline indicated in Clause 7.1.2 above, indicating the following:-

a. Order Confirmation number;

b. Reasons for Return; and

c. Whether you would like to opt for an exchange or refund.

7.5. Once your Request for Return has been reviewed by us, you will receive a Return Authorisation email containing the detailed return instructions. Returns cannot be processed if there is no Return Authorisation issued by us.

7.6. Unless an Object is deemed incorrect , defective or damaged: –

a. The shipping fees incurred for the return shall be borne by you; and

b. The original shipping fees, duties, and taxes (if applicable) are strictly not reimbursable or refundable.

7.7. Once an Object has been received by us following Return Authorisation, we require up to ten (10) business days for inspection of the returned Object and processing, subject to Clauses 7.1 to 7.3 above.

7.8. If a return has been accepted by us (post-inspection), we would process it for a refund or an exchange based on your option indicated in your Request for Return. Due to the exclusivity and limited nature of our Voyages Objects, exchanges are subject to availability and cannot be guaranteed. If an exchange is not available, we will inform you and proceed with a refund instead.

7.9. Refunds made will be issued back to the original method of payment. A confirmation email will be sent to you once the refund has been completed. The timing of the refund may vary depending on your payment provider.

7.10. For avoidance of doubt, the responsibility of an Object to be returned remains with you until they are received by us. We are not responsible for such Objects that are lost or damaged during transit. It is your responsibility to use a reliable and insured shipping service when returning an Object to us.

8. SHIPPING AND DELIVERY

PROCESSING

8.1. Subject to the exceptions set out below, orders placed on business days will be processed and shipped out within forty-eight (48) hours:-

a. For the avoidance of doubt, “business days” refer to Monday through Friday, excluding weekends and public holidays. Orders placed during weekends or public holidays observed in New York and Singapore would commence processing only on the next business day. Thereafter, the timeframe stipulated in Clause 8.1 above would apply;

b. If you wish to modify or cancel your order, please contact us as soon as possible at care@thevoyagesworld.com. Once the processing of an order has commenced, it cannot be modified or cancelled, and we would not be able to accept any changes to the order(s) including but not limited to the delivery address. If an order cannot be modified or cancelled, you may opt to return it in accordance with the Voyages Return Policy; and

c. Voyages reserves the right to cancel or suspend orders suspected of fraudulent or unauthorised activity. Additional verification may be requested before processing the order.

DISPATCH

8.2. Voyages orders are carefully prepared and dispatched from our warehouse in New York or Singapore. In order to provide the best service to you, your order will be shipped from the nearest warehouse based on the shipping address you have provided to ensure timely delivery. Orders placed with a shipping address within the United States will be dispatched from our warehouse in New York.

8.3. Shipping and order preparation may be affected during public holidays observed in New York and Singapore. In such circumstances, your order will be dispatched on the next business day,

8.4. Each Voyages Object is prepared and dispatched with the same care with which it was crafted.

ESTIMATED DELIVERY WINDOW

8.5. An estimated delivery window would be displayed at checkout based on your destination(s). The estimation provided is not intended to be a guarantee or warranty that the Objects would be delivered within the estimated delivery window and we are not liable for any delays in delivery howsoever caused. Delivery times may vary depending on destination(s), carrier conditions, and customs clearance.

8.6. For orders placed with a shipping address within the United States, the estimated delivery timing would depend on the destination within the United States, the shipping carrier and the shipping method selected.

SHIPPING METHODS

8.7. Shipping options would be provided and displayed at checkout based on the destination.

8.8. Express shipping may be available for certain regions. Shipping fees are strictly non-refundable once an order has been dispatched by us to the carrier.

8.9. Once your parcel has been collected by the carrier, you will receive a Shipping Confirmation Email with tracking details. The carrier tracking page will provide the updated delivery date. In addition to Clause 8.3 above, we are not liable for any delays howsoever caused by the carrier. We are not liable for any losses arising from the incorrect address you have provided, including but not limited to delay or failure to delivery or mis-delivery arising from incorrect information provided by you. For the avoidance of doubt, delivery would be deemed to have taken place when we deliver them to the address that you have provided.

INTERNATIONAL ORDERS

8.10. Voyages ships through trusted international carriers. Carriers may require additional information to complete custom clearance for certain destinations. If necessary, you may be contacted by the carrier directly to provide the required information and clarification. If the required information is not provided, delivery may not be possible and the parcel may be returned to Voyages dispatch location

8.11. Orders containing multiple Objects may arrive in separate shipments.

8.12. Guests are responsible for complying with all applicable export and import laws and regulations in the destination country. Voyages shall not be liable for any delays or restrictions imposed by customs authorities or regulatory agencies.

SHIPPING RESTRICTIONS

8.13. At this juncture, we are unable to ship to:-

8.13.1. P.O Boxes;

8.13.2. APO/FPO addresses;

8.13.3. General Delivery addresses;

8.13.4. U.S. Territories

8.14. Orders placed to the destinations in Clause 8.13 above may be cancelled at our sole discretion.

RISK

8.15. All shipments are fully insured until delivery.

8.16. The risk in the Objects passes to you upon delivery as defined in Clause 8.9 above.

DUTIES AND TAXES

8.17. International shipments may be subject to duties, taxes, or customs charges determined by the destination country.

8.18. Where applicable, these charges will be calculated and displayed at checkout. Unless otherwise stated, they remain the responsibility of the recipient. You are solely and exclusively responsible for any shortfall between the charges displayed at checkout and the actual duties and taxes imposed by the destination country.

8.19. Our rights to receive monies which you owe us under this contract shall not be affected in the event the contract is ended.

9. REPRESENTATION OF OBJECTS

9.1. For Objects which we have set out sizes, weights, and measurements, please note that there may be small divergencies and discrepancies in the sizes, weights, and measurements for the final Objects.

9.2. In addition, there may also be small divergence or discrepancies between the images posted on our website and the final Object.

10. MODIFICATIONS OF THE SERVICES OR THE WEB TERMS

10.1. We reserve the right to modify, update or amend the terms of the Web Terms, or to modify, suspend, or discontinue the Services at any time for any reason.

10.2. We will use commercially reasonable efforts to notify you of material changes to the Web Terms by posting a notice on our website and/or through other appropriate communication channels and/or methods as we deem to be fit and proper one (1) month prior to any changes being effected.

10.3. You are advised to review the Web Terms periodically for any changes or updates. By continuing to communicate with us, use our website, and/or utilise our services, you are deemed to have consented to and accepted the aforesaid modifications, updates, or amendments to the Web Terms.

11. INTELLECTUAL PROPERTY

11.1. You acknowledge and agree that all intellectual property rights in and associated with (i) Voyages; (ii) our Objects; and (iii) contents on our website, belong to us and are protected from unauthorised copying and dissemination by copyright law, trademark law, international conventions and other intellectual property laws.

11.2. Nothing shall be construed as granting to you, by implication, estoppel, or otherwise, any license or right to use the contents herein on the webpage, through the use of framing or otherwise, except: (a) as expressly permitted by these Terms and Conditions; or (b) with our prior written permission.

12. LIMITATION OF LIABILITY

12.1. Voyages undertakes to make reasonable efforts to ensure the accuracy of the information published on our website, and reserves the right to modify the information at any time. However, Voyages does not guarantee the accuracy, completeness, or reliability of any information on its website, and nothing on the website constitutes a warranty or representation by Voyages.

12.2. Without limiting the generality of the foregoing, Voyages shall not be liable for:

a. Any errors, inaccuracies, omissions, or typographical mistakes in the information on our website;

b. Any direct or indirect damage arising from your access to, use of, or inability to use our website;

c. Any damage caused by third-party actions, including unauthorised access or interference with our website;

d. Any issues relating to third-party services, including internet or payment service providers; and

e. Any direct or indirect damage arising from the purchase of our Objects.

12.3. As set out in our Privacy Policy, Voyages implements reasonable measures to safeguard personal data collected through our website. However, Voyages has no control over the inherent risks associated with the Internet or the systems of third-party service providers and therefore cannot guarantee the security of personal data transmitted through such systems. You acknowledge and accept that your use of our website is at your own risk.

12.4. To the extent permissible at law, Voyages shall not be liable to you, whether in contract, tort, breach of statutory duty, or otherwise, for any loss of profit, or any indirect or consequential loss arising under or in connection with any order.

12.5. Voyages’ total liability for all other losses arising under or in connection with any contract with you shall be limited to the purchase price of the relevant Object.

13. NO WARRANTY

13.1. Voyages Objects and services are provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, other than those implied by law.

14. DISPUTE RESOLUTION, ARBITRATION, AND CLASS WAIVER

INFORMAL PROCESS FIRST

14.1. You agree that in the event of any dispute between you and us, you will first contact us and make a good faith sustained effort to resolve the dispute and complying with our informal dispute resolution procedure before resorting to more formal means of resolution, including without limitation any court action or arbitration.

ARBITRATION AGREEMENT

14.2. After the informal dispute resolution process, any remaining dispute, controversy, or claim including but not limited to any contract, intellectual property or tortious matter(s) (collectively, “Claim”) arising out of or in connection with these Terms and Conditions, your use of our services, purchase or use of our Objects, or our communications with you shall be referred to and finally resolved by arbitration administered by the Singapore International Arbitration Centre (“SIAC”) in accordance with the Arbitration Rules of the Singapore International Arbitration Centre (“SIAC Rules”) for the time being in force, which rules are deemed to be incorporated by reference in this clause. The language of the arbitration shall be in English and before a sole arbitrator. This mandatory arbitration agreement applies equally to you and us and shall survive any termination of these Terms.

14.3. However, this arbitration agreement does not govern any Claim by us for infringement of our intellectual property or access to our services (including our website) that is unauthorised or exceeds authorisation granted in these Terms and Conditions. In such circumstances, we reserve the rights to apply to the Court for the appropriate remedy, including but not included to injunctions.

CLASS ACTION WAIVER

14.4. Any Claim must be brought in the respective party’s individual capacity, and not as a plaintiff or class member in any purported class, collective, representative, multiple plaintiff, or similar proceeding (“Class Action”). The parties expressly waive any ability to maintain any Class Action in any forum. If the Claim is subject to arbitration, the arbitrator shall not have authority to combine or aggregate similar claims or conduct any Class Action nor make an award to any person or entity not a party to the arbitration. Any claim that all or part of this Class Action Waiver is unenforceable, unconscionable, void, or voidable may be determined only by a court of competent jurisdiction and not by an arbitrator. The parties understand that any right to litigate in court, to have a judge or jury decide their case, or to be a party to a class or representative action, is waived, and that any claims must be decided individually, through arbitration.

14.5. This Section includes an arbitration agreement and an agreement that all claims will be brought only in an individual capacity (and not as a class action or other representative proceeding).

15. GOVERNING LAW AND JURISDICTION

15.1. These Terms are governed and interpreted pursuant to the laws of Singapore, notwithstanding any principles of conflicts of law. Any disputes in connection with these Terms that result in court action, in accordance with these Terms, will be resolved exclusively by a court located in Singapore, and you specifically consent to the personal jurisdiction of such courts and waive any claim of forum non conveniens.

16. ENTIRE AGREEMENT

16.1. These Terms are the entire agreement between you and us relating to the subject matter herein and shall not be modified except by us in accordance with these Terms and Conditions, or as otherwise agreed in writing by you and us. No employee, agent or other representative of Voyages has any authority to bind us with respect to any statement, representation, warranty or other expression not specifically set forth in these Terms.

17. SEVERABILITY AND WAIVER

17.1. If any part of these terms is unlawful, void, or unenforceable, that part will be deemed severable and will not affect the validity and enforceability of the remaining provisions. The failure of a party to require performance of any provision will not affect such party’s right to require performance at any time thereafter, nor shall a waiver of any breach or default of these Terms or any provision of these Terms constitute a waiver of any subsequent breach or default or a waiver of the provision itself.

18. ASSIGNMENT

18.1. You may not assign or transfer these Terms or any of your rights or obligations under these Terms. We may assign these Terms at any time without notice to you.

19. FORCE MAJEURE

19.1. We shall be under no obligation to provide our services if such provision is disrupted by inclement weather, strikes, labour disputes, breakdowns or disruptions in courier service, riots, war, government emergency order, military action, Acts of God, or any other cause or condition beyond our control.

20. USE AND DISCLOSURE OF PERSONAL DATA

20.1. Please refer to our Privacy Policy on how we will use personal data collected.

21. AUTHENTICATION AND TRANSFER OF OWNERSHIP

21.1. Each Object is accompanied by Voyages authentication documentation and registered within the Voyages Permanent Archive. This document confirms the origin of the Object and its record within the Voyages Archive. Certain collectible editions may include Archive numbering or additional collector materials.

21.2. Each Voyages Object carries a unique archive code linked to the Voyages Permanent Archive.

21.3. Authentication provided by Voyages confirms the origin of Objects acquired directly through Voyages or its authorised channels.

21.4. Voyages cannot guarantee the authenticity or condition of Objects obtained through third-party resellers. For the avoidance of doubt, we are not liable for any Objects obtained to third-party resellers.

21.5. You may direct all queries on authentication or verification to Voyages Client Care at care@thevoyagesworld.com.

21.6. If a Voyages Object is transferred to a new collector, the ownership record may be updated within the Voyages Archive upon request. Ownership transfers are reviewed individually and require confirmation from the original registered owner. Once approved, the archive record may be updated to reflect the new registered owner.

22. CARE AND LONGETIVITY

22.1. Our Objects are created with exceptional natural materials and traditional craftsmanship. By making a purchase, you agree that you have fully read and understand the Care Guidelines of our Objects. Please refer to our Privacy Policy page on how to care for our Objects. It shall be your responsibility to ensure that an Object is maintained in accordance with our recommended care guidelines.

22.2. Should your Object require after sale-service or repair, please contact Voyages Client Care at care@thevoyagesworld.com for more information.

22.3. Our Client Care team may arrange an assessment and repair service as determined by us on a case-by-case basis. The provision of such after sale service or repair shall be subject to separate terms and conditions, which shall be set out in the agreement to be entered into between you and ourselves at the time of your request for such after-sale service.

22.4. Voyages Objects are crafted from selected natural materials that may be rare or limited in quantity. Therefore in the event of a request for repair, we cannot guarantee the availability of materials required the repair of an Object. Nevertheless, we endeavour to assist you and advice you on the relevant care and repair.
