1.1. The Voyages World (“Voyages”, “we”, “our”, or “us”) respects your privacy and is committed to protecting your Personal Data.

1.2. This Privacy Policy explains how we collect, use, disclose, process, and safeguard your Personal Data when you visit or shop on our website, thevoyagesworld.com, or interact with our internet-based advertising. It also describes your data rights and the controls available to you to manage your Personal Data and protect your privacy.

1.3. This Privacy Policy complies with the requirements of the Personal Data Protection Act 2012 (the “PDPA”). The PDPA establishes a general data protection law in Singapore which governs the collection, use, and disclosure of individuals’ personal data by organisations in a manner that recognises both the right of individuals to protect their personal data and the need of organisations to collect, use, disclose personal data for purposes that a reasonable person would consider appropriate in the circumstances. For the avoidance of doubt, this Privacy Policy is governed by the laws of Singapore.

1.4. Pursuant to the requirements of the PDPA, this Privacy Policy is notified to all customers. Please read through this Privacy Policy before providing us with your Personal Data. When you provide us with your Personal Data, you consent to our collection, use, disclosure, and retention of your Personal Data in accordance with this Privacy Policy and as otherwise permitted by the PDPA.

2. DEFINITIONS

2.1. For the purposes of this Privacy Policy:

a. “Account” refers to a unique account created for you to access our website;

b. “Country” refers to Singapore;

c. “Cookies” refers to the data file placed on a computer or device when it is used to visit our website, to enhance your browsing experience by remembering your preferences and enabling certain website functionalities;

d. “Device” refers to any electronic device that can access our website, including but not limited to a computer, mobile phone, or digital tablet;

e. “Object” or “Objects” refers to a product or products created with rare materials and traditional craftmanship, collectibles, and selected archive pieces curated by the Voyages House;

f. “Personal Data” refers to any information that relates to an identified or identifiable individual including but not limited to your name, address, phone number, identity card number, email address, personal preferences, information about your spouse or family members, bank account details, and any other data that may identify you, your spouse, or family members, which has been or may be collected, stored, used, and processed by us periodically;

g. “Private Access” refers to the invitation-based and time-limited admission for selected guests to experience and purchase Objects via Voyages Private Salon;

h. “Voyages Private Salon” refers to a restricted-access section on our website. Access is granted only to selected guests who have submitted a Private Access request and have received an approved access link from us. Only guests with a valid access link may enter the Private Salon to view and purchase Objects made available during the Access Period; and

i. “Access Period” refers to the time-limited purchasing window during which selected guests are granted Private Access to purchase Objects from a given Voyages Chapter.

3. WHAT PERSONAL DATA VOYAGES COLLECTS

3.1. Voyages only collects, uses, discloses, and/or processes your Personal Data where necessary to provide services to you. Depending on your selected controls and how you interact with us, we may collect:

a. ACCOUNT INFORMATION:
When you register an Account with us to request for Private Access, we may collect the following information from you:

(i) Name

(ii) Email address

(iii) Gender

(iv) Date of birth

(v) Phone number

b. PURCHASE INFORMATION:
When you purchase Objects from us, as part of the sale and purchase process, we may collect the following information from you:

(i) Name

(ii) Email address

(iii) Phone number

(v) Billing and shipping address

c. WEBSITE AND DEVICE INFORMATION:

f. CHILDREN UNDER 18:
Voyages respects the privacy of children. We will not use or retain the Personal Data of any children below the legal age of 18 even if the same was provided by you for any reason whatsoever. For the avoidance of doubt, this clause does not impose any obligation on Voyages to independently verify the age of the users of our website or the accuracy of the information provided to us. It is your responsibility to ensure that you do not submit Personal Data on behalf of individuals under the legal age of 18 without appropriate consent or authorisation.

4. WHEN VOYAGES COLLECTS YOUR PERSONAL DATA

4.1. Voyages may collect your Personal Data through the following channels:

a. Use of thevoyagesworld.com;

b. Voyages events you attend;

c. Contact with Voyages Client Care;

d. Forms you complete;

e. Digital applications you use;

f. Voyages social media pages you visit or interact with; or

g. Digital advertising you interact with.

5. HOW AND WHY VOYAGES USES YOUR PERSONAL DATA

5.1. Voyages may collect, use, disclose, and/or process your Personal Data for the following purposes:

a. to create and maintain your Account on our website for Private Access;

b. to communicate with you to notify you of your eligibility for Private Access;

c. to process your orders, payment for your orders, and delivery of your orders;

d. to process any refunds of your orders;

e. to maintain and monitor the usage of our website;

f. to provide personalised marketing to you about Voyages products and services;

g. to manage your queries or requests to Voyages Client Care;

h. to conduct data analysis, identify usage trends, and analyse your preferences for the purpose of improving your Voyages experience; and

i. for any other purpose permissible under the PDPA including but not limited to purposes which a reasonable person would consider appropriate in the circumstances.

6. HOW VOYAGES DISCLOSES YOUR PERSONAL DATA

6.1. Voyages does not sell any of your Personal Data to any third party.

6.2. However, Voyages may engage trusted third-party service providers to support the operation of our services. Accordingly, your Personal Data may be disclosed to or made accessible to such third parties, inclusive of but not limited to the following, on a need-to-know basis:

a. companies involved in managing our website, including information technology service providers and security systems providers;

b. companies involved in managing your orders, such as payment service providers, warehouses, order packers, logistics service providers, shipping partners, and delivery companies;

c. professional service providers who provide marketing, advertising, analytics, and similar services for Voyages;

d. professional advisors and external auditors;

e. banks and financial institutions;

f. regulatory and governmental authorities in order to comply with statutory and government requirements; and

g. companies approved by you, such as social media sites (if you choose to link your social media account to us), anti-fraud detection and prevention entities.

6.3. We may provide the aforementioned third parties with aggregated but anonymised information and analytics about you which do not identify you.

6.4. While Voyages engages trusted third-party service providers that maintain appropriate security and privacy standards, certain services are provided independently by these third-party service providers, and Voyages does not have control of their systems or operations. Nevertheless, we will take reasonable measures to ensure that any third party handling your Personal Data protects it in a manner consistent with this Privacy Policy and in accordance with the PDPA.

6.5. As the principal company of Voyages, Jessicacindy Pte. Ltd. may have access to your Personal Data. Such access may include access by the employees, agents, representatives, and directors of Jessicacindy Pte. Ltd.

6.6. Voyages may disclose your Personal Data with a third party in connection with a proposed or actual business transaction, such as a corporate reorganisation, merger or acquisition, or the sale of some or all of our business or assets. We will require that the recipient of your Personal Data agree to protect your Personal Data in a manner that is consistent with this Privacy Policy and in accordance with the PDPA.

7. RETENTION OF YOUR PERSONAL DATA

7.1. Voyages will retain your Personal Data only for as long as is necessary for the purposes which the Personal Data is collected and retained as set out in this Privacy Policy. We will retain and use your Personal Data to the extent necessary to comply with our legal obligations, resolve disputes, enforce our legal agreements and policies, and conduct our business operations.

7.2. When your Personal Data is no longer required for the purposes which the Personal Data is collected and retained for, or any of our operational or legal purposes, we will exercise the necessary measures to ensure that your Personal Data is either destroyed or anonymised.

8. TRANSFER OF YOUR PERSONAL DATA

8.1. As part of our operations, Voyages may transfer your Personal Data to third-party service providers located outside your country of residence (including the United States and other countries) on a need-to-know basis. The data protection laws in such jurisdictions may differ from those of your jurisdiction.

8.2. By agreeing to this Privacy Policy and providing your Personal Data in the usage of our services, you acknowledge and consent to the aforementioned transfer of your Personal Data.

8.3. Where Voyages makes such transfers of your Personal Data outside your jurisdiction, we will adopt appropriate safeguards to ensure that your Personal Data remains protected in accordance with the PDPA, including through appropriate contractual measures.

9. SECURITY OF YOUR PERSONAL DATA

9.1. Voyages maintains appropriate security safeguards designed to protect your Personal Data against accidental, unlawful, or unauthorised access, use, disclosure, alteration, loss, and/or destruction. However, no method of transmission or storage would be completely secure. Although we strive to use commercially acceptable methods to protect your Personal Data, absolute security cannot be guaranteed, especially in situations beyond our control, such as cyberattacks, data breaches, or unauthorised access resulting from vulnerabilities in third-party systems or user devices. Nonetheless, Voyages is committed to continually reviewing and improving its security protocols to minimise such risks.

9.2. Should there be a notifiable data breach as defined in section 26B of the PDPA, Voyages will inform any individuals affected by the aforesaid notifiable data breach in a manner that is reasonable in the circumstances and in accordance with section 26D of the PDPA. For the avoidance of doubt, section 26D(5) to 26D(7) of the PDPA shall apply in the circumstances where notice to you is not required.

10. COLLECTION, USE, AND DISCLOSURE WITHOUT CONSENT

10.1. Voyages may:

a. collect Personal Data about you from a source other than you, in the circumstances or for the purposes, and subject to any condition, in the First Schedule or Part 1 of the Second Schedule of the PDPA;

b. use Personal Data about you without your consent, in the circumstances or for the purposes, and subject to any condition, in the First Schedule or Part 2 of the Second Schedule of the PDPA; or

c. disclose Personal Data about you without your consent, in the circumstances or for the purposes, and subject to any condition, in the First Schedule or Part 3 of the Second Schedule of the PDPA.

10.2. For the avoidance of doubt, section 17 of the PDPA would apply and we would rely on exceptions under the PDPA which permit our collection, use, disclosure, transfer, and/or processing of your Personal Data without your consent, including but not limited to the Legitimate Interests Exception and the Business Improvement Exception.

11. WEBSITE COOKIES

11.1. Voyages may collect certain information about your use of our website through the use of Cookies. This allows us to understand how our website is used and to improve and personalise your experience when using our website.

11.2. If you do not wish for your Personal Data to be collected through Cookies on our website, you may disable Cookies through your browser settings.

12. YOUR RIGHTS

12.1. Subject to the relevant provisions of the PDPA, any applicable legal restrictions and contractual conditions, you shall have the right to:

a. access your Personal Data by asking us for a copy of your Personal Data;

b. request Voyages to correct any of your Personal Data which is inaccurate, incomplete or out of date. We will inform you of the reasons if we are unable to fulfil your request. Additionally, Voyages reserves the right to exercise discretion in approving the requested corrections and may request additional documentation to verify the new data, ensuring accuracy and preventing fraud;

c. request Voyages to delete any of your Personal Data, subject to any applicable legal or other requirement to maintain certain records of your Personal Data. Please note that the deletion of your Personal Data from our database will result in us not being able to provide you with the products or services that you have requested from us; and

d. withdraw your consent to Voyages for the processing of your Personal Data in accordance with the terms of this Privacy Policy. Please note that notwithstanding the withdrawal of your consent, we may still proceed to process your Personal Data in circumstances recognised and permitted by law and as required under the contractual conditions.

12.2. To exercise your aforementioned rights, you may send your request in writing to Voyages Client Care at order@thevoyagesworld.com.

13. CONSEQUENCES OF FAILURE TO SUPPLY PERSONAL DATA

Failure to provide reasonably sufficient Personal Data may prevent Voyages from carrying out certain operations, including providing its services to you, communicating with you, and processing or fulfilling your orders.

14. CHANGES TO THIS PRIVACY POLICY

14.1. Voyages reserves the right to modify, update or amend the terms of this Privacy Policy at any time. We will notify you of any changes by posting the new Privacy Policy on our website or through other appropriate communication channels and/or methods as we deem to be fit and proper.

14.2. You are advised to review this Privacy Policy periodically for any changes or updates to this Privacy Policy. By continuing to communicate with us or to use our website, you are deemed to have consented to and accepted the aforesaid modifications, updates, or amendments to this Privacy Policy.
